These terms govern your use of Arbiter, a self-custody cryptocurrency wallet published by Cake Labs. By installing or using Arbiter you agree to them. If you do not agree, do not use the app.

1. What Arbiter is

Arbiter is a non-custodial wallet for the Arbitrum network with trading on Hyperliquid built in. Keys are generated on your device and stored on your device. We never hold, control or have access to your funds, your seed phrase or your private keys.

We cannot recover your wallet. If you lose your seed phrase and lose access to your device, your funds are gone permanently. No one at Cake Labs can restore them, reverse a transaction, or freeze an address.

2. Fees

Arbiter charges a builder fee of 0.03% of order value on each trade you place through the app. The fee is collected by Hyperliquid at the protocol level and paid to Arbiter. It is charged in addition to Hyperliquid's own trading fees, which we do not receive.

Before your first trade, the app signs a one-time authorisation permitting this fee, as Hyperliquid requires. The current rate is always stated in the latest version of these terms.

We may change our fees. Changes take effect for trades placed after the updated rate appears in the app.

3. Trading risk

Perpetual futures are high risk. Leverage magnifies losses as well as gains. You can lose your entire margin, and positions can be liquidated automatically when the market moves against you. Only trade with funds you can afford to lose entirely.

Markets can move faster than orders execute. Stop-losses are not guaranteed to fill at the trigger price, and in fast markets may fill materially worse. Network congestion, exchange downtime or connectivity loss may prevent an order being placed, modified or cancelled at all.

4. No advice

Arbiter provides software. It does not provide investment, financial, legal or tax advice, and nothing in the app or on this site is a recommendation to buy, sell or hold anything. Prices, charts, funding rates and any other market data are provided for information only, come from third parties, and may be delayed or wrong. Decisions you make are your own.

5. Third-party services

Arbiter connects to services we do not operate and cannot control:

We are not responsible for the availability, accuracy, pricing or conduct of these services, nor for losses arising from their failure.

6. Eligibility and your responsibilities

You must be of legal age in your jurisdiction and legally permitted to use a self-custody wallet and trade derivatives where you live. It is your responsibility to determine that, and to meet any tax obligations arising from your activity. Do not use Arbiter if doing so would breach the law that applies to you, or where you are subject to sanctions.

You are responsible for keeping your seed phrase, PIN and device secure, for the accuracy of every address and amount you enter, and for the consequences of transactions you sign. Blockchain transactions cannot be reversed.

7. Availability

We may change, suspend or discontinue any part of Arbiter at any time. Because the wallet is self-custody, your funds remain yours and recoverable with your seed phrase in any compatible wallet, regardless of what happens to the app or to us.

8. Warranties and liability

Arbiter is provided "as is" and "as available", without warranty of any kind, to the fullest extent permitted by law. To that same extent, Cake Labs is not liable for lost profits, lost funds, missed or failed trades, liquidations, or any indirect or consequential loss arising from your use of the app or of the third-party services it connects to.

Nothing in these terms excludes liability that cannot lawfully be excluded.

9. Changes

We may update these terms. Material changes will be reflected in the "last updated" date above, and continued use of the app after that constitutes acceptance.
